END USER LICENSE AGREEMENT (EULA)

1. ACCEPTANCE OF TERMS

By downloading, installing, or using FaceMax: Boost Your Aura ("the App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree to these terms, do not download, install, or use the App.

2. LICENSE GRANT

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

3. RESTRICTIONS

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels on the App
• Use the App for any illegal or unauthorized purpose
• Use the App to upload inappropriate, offensive, or copyrighted content
• Attempt to gain unauthorized access to the App or its related systems

4. AUTO-RENEWABLE SUBSCRIPTIONS

4.1 Subscription Plans

We offer the following auto-renewable subscription plans:

• Premium Plan: Weekly auto-renewable subscription at $3.99 per week
• Referred Plan: Weekly auto-renewable subscription at $1.99 per week (available through referral discount)

4.2 Subscription Terms

• Length: 1 week for both plans
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Price per unit: $3.99 per week (Premium Plan) or $1.99 per week (Referred Plan)
• Billing: You will be charged weekly for the duration of your subscription

4.3 Payment and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Your account will be charged for renewal within 24 hours prior to the end of the current weekly period
• You can manage and cancel your subscription by going to your Apple ID Account Settings after purchase
• Subscription pricing may vary by region and will be displayed in your local currency in the App Store

4.4 Cancellation

• You may cancel your subscription at any time through your Apple ID Account Settings
• Cancellation takes effect at the end of the current billing period
• No refunds will be provided for unused portions of the subscription period
• You will continue to have access to premium features until the end of your current billing cycle

4.5 Referral Discount

The Referred Plan discount is available to users who access the app through a valid referral link. This discounted rate applies for the duration of the subscription as long as it remains active. If you cancel and later resubscribe without a valid referral, standard pricing will apply.

5. USER CONTENT AND FACIAL IMAGES

5.1 Your Content

You retain ownership of any facial images or content you upload to the App. By using the App, you grant us a limited license to process your images solely for providing the AI enhancement services.

5.2 Image Processing

• Facial images are used exclusively for AI-based analysis and enhancement
• Images are temporarily stored and deleted within 24 hours unless saved
• Saved images are retained for maximum 30 days then permanently deleted
• We do not perform biometric identification or facial recognition

6. PRIVACY

Your privacy is important to us. Our collection, use, and disclosure of your information is governed by our Privacy Policy, which is incorporated into this EULA by reference. Please review our Privacy Policy at Privacy Policy.

7. INTELLECTUAL PROPERTY

The App and all its content, features, and functionality are owned by FaceMax and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved.

8. DISCLAIMERS

8.1 Service Availability

We do not guarantee that the App will be available at all times or that it will be free from errors, viruses, or other harmful components.

8.2 AI Results

AI-generated enhancements and analyses are for entertainment purposes only. Results may not be accurate and should not be relied upon for any serious decision-making.

8.3 No Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of this EULA.

11. TERMINATION

11.1 Termination by You

You may terminate this EULA at any time by deleting the App from your device.

11.2 Termination by Us

We may terminate this EULA immediately if you breach any terms, with or without notice.

11.3 Effect of Termination

Upon termination, your right to use the App ceases, and you must delete the App from your device.

12. UPDATES AND MODIFICATIONS

We reserve the right to modify the App and this EULA at any time. Continued use of the App after changes constitutes acceptance of the modified terms.

13. GOVERNING LAW

This EULA is governed by the laws of the United States and the state where our company is incorporated, without regard to conflict of law principles.

14. DISPUTE RESOLUTION

Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. SEVERABILITY

If any provision of this EULA is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. ENTIRE AGREEMENT

This EULA, together with our Privacy Policy, constitutes the entire agreement between you and us regarding the App.

18.3 Product Claims

Any claims relating to product liability, legal compliance, or intellectual property infringement are between you and us, not Apple.
